The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized. Amendment V. United States of America Case Number: 2024 CMD 011498 v. Case Number: 2024 CMD 012698 Appeal Number: 25-CO-0600 Milan Stevenson Summary of the Case: I did not commit simple assault. I was arrested on hearsay, and I was the victim of illegal search and seizure. I was not given proper custodial receipt of my property. I was then released without my own consent or recognizance and then I was arrested again after being released illegally, I told the judge I did not want to be released on OR. I was never given adequate legal counsel. The first lawyer, appointed did not show up. I requested that [redacted] be dropped from my legal counsel, then requested new counsel for my appeal and was again paired with [redacted]. He has told me that I am not allowed to file or submit a Summons or Subpoena form, which is necessary to introduce exculpatory evidence against the Simple Assault arrest. There is a limit to lawyers that can be appointed per the Criminal Justice Act. Statement of the Case: I did not commit simple assault on November 12th, 2025 at 10:36. And at the aforementioned time my United States Constitutional Rights were violated because there was no probable cause for the arrest. The District of Columbia Code 22-404(a)(1) states that Simple Assault consists of “An attempt or effort with force or violence to do injury to the person of another And, at the time such attempt or effort was made, the accused had the apparent present ability to affect such injury; and at the time of the commission of the Assault, the accused intended to do the acts which constitute the assault. I told Police Officers [redacted] and [redacted] that no such crime had occurred and they both had body cameras on and had no probable cause for the arrest. They just took the accusers word over mine. The arrest violated the fourteenth amendment. After being arrested I was not given proper custodial receipt of my property which contained: (1) Solid Gold Ring, and (2) an Apple Phone which I received from the homeless veterans crrc. I was under a state of arrest (because charges were pending against me.) I was not given adequate legal counsel. I told the judge myself that I did not wish to be released due to the inadequate amount of time with legal counsel and was ignored. After the initial arrest I was released without my consent and then arrested again for violation of the initial arrest which was the false arrest for simple assault. I am requesting complete acquittal because the arrest was illegal and there was no probable cause. There was no evidence just hearsay. The confrontation clause allowing me to cross-examine the people saying I committed the simple assault was denied and violated. The Veterans Administrations Veterans Disability was lowered as a result, as well as my SNAP benefits. Argument(s): Relief Sought: 2 Million for false Arrest.
